Overview

As a professional, you owe a duty at law to your clients (and to others) to ensure that they are not injured, damaged or made to suffer a loss as a result of your professional activities. Any breach of that duty (whether negligent or accidental) could lead to a legal liability falling upon you involving very substantial damages (not to mention the costs of legal advice and defence).

Professional Indemnity is essential insurance protection that will cover a professional person or firm against the cost of rectifying most mistakes, whether these are made by partners (or directors) or staff. We can provide cover for 'any civil liability arising out of professional business', the term 'professional business' being defined as 'any advice given or services performed'. Typically, these policies are available to the established professions where high volumes of business are placed in the insurance market.

The less comprehensive policy covers breach of professional duty, negligence or breach of contract arising out of certain specified activities. Such policies can usually be extended to include cover for some of the components automatically covered by the civil liability policy. These include libel and slander, breach of copyright, breach of trust and the like. Additional extensions include inter alia fidelity, dishonesty and loss of documents.

We cover a broad ranges of professions including but not limited to Advertising Agents, Computer Consultants, Management Consultants, Solicitors, Architects & Engineers, Accountants and Insurance Brokers.

Medical Professional Liability

Brit Insurance do not directly write Medical Malpractice Liability Insurance but as part of our suite of insurance products we partner specialist Lloyd’s Coverholder, MPLC.

MPLC’s policies provide legal liability cover for claims made against healthcare institutions and professionals arising out of the provision of medical services.

These policies cover death, bodily injury, mental injury, illness or disease caused to any patient. All of their policies provide automatic cover for ‘Good Samaritan’ acts administered at the scene of a medical emergency, accident or disaster.

MPLC are able to provide cover with limits up to a currency equivalent of GBP20M Any One Claim and GBP40M in the Aggregate for a wide range of companies, individuals and associations on a worldwide basis excluding USA.

Accountants

We focus on medium sized practices with a good mix of clients. We generally look for practices undertaking traditional work such as accountancy, audits & taxation work for private individuals and companies. We are able to write heavier areas of work as part of a “mixed discipline” practice, but prefer exposures with a maximum of 15% in respect of mergers, acquisitions and disposals.

Architects & Engineers

The emphasis is on well established practices that have the appropriate experience in relation to contracts undertaken. Consistency in relation to both the type and size of contracts completed and those tendered for is deemed a positive feature. We generally avoid high rise contracts (over 5 storeys) and work undertaken in areas such as roofing, cladding, curtain walling, flooring and glazing, unless we exclude the consequential loss and bodily injury exposures.

Design & Construct

We are able to write full design and construct exposures and those contingent exposures where the design element of the contract is subcontracted to specialist designers & consultants. A full range of trades are considered including (but not limited to) general building work (new build & refurbishment) heating and ventilation, mechanical & refrigeration, interior design & shop fit out.

Insurance Brokers

We target small to medium provisional Intermediaries predominantly undertaking general insurance business including those with binding authorities, (for which an additional questionnaire is required). We generally avoid reinsurance brokers and risks where the investment and financial services exposures are more than incidental.

Miscellaneous Professions

Many emerging and diverse trades that include organisers of various events, employment agencies, fitness trainers including ‘lifestyle’ coaches, graphic designers, health & safety consultants, laboratory and analytical researchers, marketing and market researchers, personnel & human resource consultants, translators, transport, distribution & logistics consultants. CV’s should be included with the proposal form.
